Terms

These terms apply to all contracts between you and Kassandra Flinterhoff (Kassandras Art), self-employed artist in Valencia, Spain. My full contact details are in the legal notice. You can reach me at hi@kassandra.studio or +34 611 780 510.

This website is not an online shop. The artworks, prints and prices shown are not binding offers but an invitation to send me an inquiry.

1. You send me an inquiry via the contact form, by email, phone or messenger.
2. I reply with a written offer by email containing the artwork, the final price including VAT, shipping costs, payment method, delivery time, information on your right of withdrawal and this model withdrawal form.
3. The contract is concluded when you accept my offer in writing (e.g. by email). I confirm the contract by email.

All prices are final prices in euros including VAT. Shipping costs are stated separately in the offer.

Payment is made in advance by bank transfer, Bizum or PayPal. I reserve the artwork for you for 7 days after the contract is concluded; it is shipped once payment has been received. For commissions, a deposit is agreed in the offer.

I ship within the EU and, on request, worldwide. Originals are carefully packed and shipped with tracking. Canvas prints are produced by Galerie Munk in Germany and shipped free of charge within the EU. The delivery time is stated in the offer; prints made to order usually take 5–7 working days. Personal handover in Valencia is possible by arrangement.

If you are a consumer, you have the right to withdraw from the contract within 14 days without giving any reason. This applies to originals from my portfolio, fine art prints in standard formats and canvas prints in standard sizes, as well as to multi-session passes and gift vouchers until their first use.

The withdrawal period is 14 days from the day on which you, or a third party named by you who is not the carrier, take possession of the goods.

To exercise your right of withdrawal, you must inform me (Kassandra Flinterhoff, postal address in the legal notice, hi@kassandra.studio, +34 611 780 510) by means of a clear statement (e.g. a letter or email) of your decision to withdraw from the contract. You can use the model withdrawal form below, but this is not obligatory. To meet the deadline, it is sufficient to send your notice before the withdrawal period expires.

Effects of withdrawal: I will reimburse all payments received from you, including standard delivery costs, without undue delay and no later than 14 days from the day on which I receive your notice of withdrawal. I will use the same means of payment you used, unless expressly agreed otherwise. I may withhold reimbursement until I have received the goods back or you have supplied proof of having sent them back. Please send the goods back within 14 days; you bear the direct cost of returning them. You are only liable for any loss in value resulting from handling the goods beyond what is necessary to establish their nature, characteristics and functioning.

There is no right of withdrawal for goods made to your specifications or clearly personalised (Art. 103 c) TRLGDCU). This applies to commissions, custom silhouettes and prints or canvas prints in custom sizes. I will point this out to you in writing before the contract is concluded.

There is also no right of withdrawal for leisure services provided on a specific date, such as a workshop with a fixed date (Art. 103 l) TRLGDCU). The cancellation rules in section 8 apply instead.

Before I start a commission, you receive a written offer with a description of the artwork, size, price, deposit, delivery time and the review step. I keep you updated during the process; minor artistic deviations from the agreed design are part of the creative process. Copyright in the artwork remains with me; you acquire ownership of the painting. I will only show commissioned works in my portfolio or on social media with your consent – for portraits and silhouettes also with the consent of the people depicted.

Workshops are currently on pause. When they start again, the following applies:

• Your place is reserved once you have paid; the exact location in Valencia is shared with your booking confirmation.
• You can cancel free of charge up to 7 days before the date. After that, the fee cannot be refunded, but you are welcome to send someone in your place.
• If I have to cancel a workshop, you get your money back in full or can switch to another date.
• Multi-session passes and gift vouchers can be withdrawn within 14 days until their first use. Gift vouchers are valid for six months.
• Photos of participants are only taken and published with separate, voluntary consent.

The statutory warranty for goods applies (three years under Spanish consumer law). Hand-painted originals show the traces of the artistic process – brushstrokes, texture, small irregularities. These are characteristics of a unique piece, not defects. If something arrives damaged, please contact me straight away with a photo.

Spanish law applies. If you are a consumer with habitual residence in another EU country, the mandatory consumer protection rules of that country remain unaffected. If you have a complaint, please write to me first – I'm sure we'll find a solution together.
